Investigation and final report 2001 Avjet Aspen crash

following crash, aircraft s cockpit voice recorder recovered wreckage , data recorded found intact , usable. under code of federal regulations (cfr) part 135 air taxi rules, no flight data recorder required type of flight , 1 had not been installed.


part of subsequent ntsb investigation focused on fact instrument approach @ destination airport not legal night landing, , overall pressure applied on charter company , flight crew charter customer complete flight original destination. according witnesses, charter customer, upon learning flight might have diverted alternate airport due night landing restriction, had business assistant call avjet management, let them know airplane not going redirected .


in addition, witnesses claimed when charter customer learned captain had discussed possible diversion of passengers waiting late arrivals, had assistant call avjet instruct captain keep comments himself .


the avjet charter department scheduler subsequently testified captain felt important land @ [aspen] because of substantial amount of money [charter] customer spent dinner party .

based on information obtained cockpit voice recorder, flight attendant had escorted unidentified male passenger flight deck s jump seat during approach sequence. according ntsb s analysis, presence of passenger in cockpit, if charter customer, further heightened pressure on flight crew land @ [aspen] .


the ntsb issued final report on june 11, 2002, following probable cause:



the national transportation safety board determines probable cause of accident flight crew s operation of airplane below minimum descent altitude without appropriate visual reference runway.



the ntsb added following contributing factors:



contributing cause of accident federal aviation administration s (faa) unclear wording of march 27, 2001 notice airmen regarding nighttime restriction vor/dme-c approach airport , faa s failure communicate restriction aspen tower; inability of flight crew adequately see mountainous terrain because of darkness , weather conditions; , pressure on captain land charter customer , because of airplane s delayed departure , airport s nighttime landing restriction.
